My boyfriend was charged with a misdemeanor in Maryland and put on unsupervised probation in 2006. He was told that as long as he stayed out of MD he would be OK. He recently turned himself in on a warrant that he had from 2005 in Westchester and was asked to serve 6 months. He is currently serving the sentence and should be released next month. Only problem is that he was arrested before that for possession of 1 bag of marijuana worth $10 in the Bronx. And we are wondering if he could have violated probation because of it. He does not have any warrants in NY or any detainers when he checked about two weeks ago. Can he be extradited to MD?

If Fr_Chuck and excon could reply I would really appreciate it. I have seen a previous post that you two were on and I felt that your legal expertise would really help me in this matter.

Hello Need:

If he was busted before he was on probation they can't violate him. Plus, it doesn't sound like they are pursuing the pot charge.
