View Full Version : Florida Leasing Law - Can I get out of my lease

I live in Jacksonville Florida and was notified by my company on Wednesday October 24, 2007 that I was being laid off.

I notified my apartments management company of my need to move because of lack of income. They said...

1. You cannot pay to break your lease.
2. You have to continue to pay your lease until someone else moves in.

My lease does not end until March of 2008.

What they do not know is I was given a nice severence package from my company, but if I'm not planning on living there, I don't want to have to pay.

I am moving back to my home state 1000 miles away.

Can anyone help me?

Sorry but they are correct. You are responsible for the lease until someone can move in. Plus, under Florida law, they are not required to try and rent the place until the lease expires.

I would say you have 3 options.

1) Sublet, if the lease permits
2) help find someone to take over the lease
3) See if they will accept a buyout.

If they will be working on replacing you, then I would try sticking it out until they do.

I would love to know the answer to this I too live in jacksonville fl and I have a 1 year lease and wish to transfer to another school
