I am on probation for a white collar crime. My spouse has a checking account in his name only. My probation officer wants to see statements from my spouse's account. Is my spouse obligated to furnish that information?

What reason is the PO giving for seeing the statement's?

She said that since we were married, she had to see all accounts.

Ask her to show you what rules allow this and what she is looking for. I don't see any justification for this. Of course if you give her a hard time, she can make things harder for you.

She has a right to see any account with YOUR name on it. But your husbands separate account is none of her business. HE'S not on probation. I certainly wouldn't comply. It also isn't surprising that she doesn't know the law - not at all.

Yes, they're going to make things harder. They make 'em hard enough already, so I NEVER lay down for them.

I don't see why he would be. He's not the one on probation. Unfortunately, probation officers often get away with this kind of stuff because they can always threaten you with a violation if you don't comply with their demands and it puts you between a rock and a hard place.

Thanks so much for the answers. This is the first time I have been in trouble and I can't seem to get very good answers from the probation officer.
Should my spouse and I separate everything and put all our assets such as cars and the like in his name?
If I pay all my restitution upfront, does the probation officer still have a right to see my checking account and such?

Why does the probation officer want to see tax returns from 3 years ago?

I ask for a written policy and procedure manual and she said they did not have one. Is this unusual?
