View Full Version : Writ dismissed now what?

OK on Monday after a month of fighting for it my writ was dismissed based on the exemption status in Florida. The money in my bank account was from SS and Wages only. The judge gave me a certified copy at no charge to take to my bank to have my money quickly returned to me. Well I took it to my bank, who faxed it somewhere, I contacted the loss prevention woman that had been working with me and she had not received it so I resent it. Monday afternoon. As of today I am still waiting for them to release my funds to me. What I don't understand is they froze my account in minutes of receiving the garnishment but releasing it seems to be not as important.
Do banks have a certain time in which they must react?

What is frustrating is that I don't believe they should have garnished my account in the first place due to the fact the bank that was listed on the garnishment was not even them.

Any help requested...

Your funds should have been release right then and there. Go to the bank and demand they be return now.

I tried that and I was told that they must wait on their attorney they can not effectively do anything until she releases the funds.

That is not quite true ,since they will freeze the account as soon aas they receive a writ, now the certified copy from the court is a release. Tell them you want interest on your funds.
