I mother died in May 07. My brother had her sign a "Quit Deed" claim for one of her three properties which was suppose to be divided between her three children. He claims she wanted him to have it, now he wants 1/3 of her remaining properties. Her will says 'the properties are to be shared like between them'. I don't believe this is fair and sharing the remaining properties is NOT shared and share alike.

Hear say, she let him used that property as collatieral for a business loan. She claims she was investing in his business. But 2003, the quit deed claims was made, when he promised her he was going to fix the place up and use the rent money to help pay for her bills. Until her death, she often asked about that property, thinking it was hers. It even went through HUD. I believe she had Dementia starting back in 2001. If I can get a medical (proof) statement indentifying this health problem what can I do to change his single ownership of that property or can I use it in court to show he has already received his 1/3 of her properties. He just received his inheritance before she died. HELP.

He never mentioned what he had done back then to any of the other siblings and led us to believe all that time that she still owned the property. I smell a rat. :(

Contact an attorney to review the matter.

Did she have a will?

Get a lawyer. If you can prove she was incapable of understanding what she was signing, then you should be able to void the deed.
