I know there is a limitation on filing small claims. What is the limitation for filing small claims for medical bills that were supposed to be paid by medicaid? I live in Wisconsin, had moved here, went to a cancer doctor, I used to live in North Carolina and the medicaid was from there. The receptionist told me they got NC"S OK for treatment, I never signed anything for the treatment so how can they sue me? This was over 2 years ago.

Statute of limitations in Wisconsin is 6 years. So if these bills are from 2005, they are legally allowed to try and collect their money up until 2011. However, if they file a small claims suit against you and win, that judgment can stay on for 20 years and you're obligated to pay it.

I would look into why Medicaid didn't pay the bills. You should have gotten a notification with an explanation as to why the payment was declined. In most states, hospitals or doctor's offices have posted that if your insurance(in this case, Medicaid) does not cover your procedure, then you are obligated to pay the balance.
