I am wondering I'm plaining to move and live with my fiancé and he lives in canada and I have never been married to my children's dads and if I leave do I get charged with kidnappin ?

If you have any type of visitation order set through the courts, you have to get the biofathers consent first, before moving even out of state with his children.

What does the custody/visitation order stipulate? Unless you've been specifically ordered not to (for the sake of the father's visitation), then you can go. However, you may have to return to court if the father decides to pursue visitation. HE may also go to court and try to specifically prevent you from moving.

If you have no court order for visitation, or child support, or anything in regards to children... then you are free to move where you please.

Hello mommy:
Even though there's been NO court action so far, IF the answer to any of Scott's questions is YES, then the children's dad CAN stop you. No, you won't be charged with kidnapping, but you'll be prevented from moving, or you'll have to move back.

One of them pay child support but gave me permission to take her with me and my sons father gave me full custody of my son and he volintary pays child support and everything so I hope I can cause that's were my family is and that's were I need to be
