My son-in-law was a passenger in a car driven by a drunk driver. They wrecked (1 vehicle accident) he was killed leaving behind wife and two small children. The vehicle belonged to the drivers girlfriend. If the car had insurance, will my daughter be able to get any kind of settlement?

That is a question that the insurance company can answer. Did the driver of the vehicle have permission to drive the car? Was he listed on her insurance as a driver of the car? The man who drove the car was drunk. Why isn't he liable for the personal injuries? Was he charged with any crime? Since the driver was drunk, the insurance company may say they are not responsible. Does your state have a fund to recompense families in such an accident? (I ask because my state does).

Have you talked to an attorney about this? The first call and most likely the first visit would be free.

First, I am not an attorney and you best source of advice is your attorney. And the answers all depend on what kind of insurance was on the vehicle and the state the accident occurred in. First, I am sure your atty will want to determine the kinds of insurance on the veh and he/she will be familiar with the insurance laws of the state as well as other laws that might be useful to pursue the drunk driver legally. I could take guesses but we don't know what state or what types of insurance the ownere of the veh had inforce. I suggest you consult an attorney.

If there is insurance on the car and if the person driving had permission to use the car. But if all those answers are yes, then you should get some money up to the max of their policy, considering that some policies have 25,000 max, and not many up to 100,000, so don't expect a large settlement
