I'm renting a room in my house. No lease. The tenant is $560 in arrears. I served him a
Notice Sept 5th stating Immediate Payment is Required. He then paid $150. And I sent
Another Full Payment Due Notice.

I need to know
1. the proper form (eviction 30 day notice?)
2. if I can serve it myself
- or who to call for a server
3. the place to file (small claims?)
4. how and when to legally remove left over belongings.
5. when I can change the locks.
6. if I DO need a lawyer.
- can I save money and use any legal aid?
7. anything else I haven't thought of.

Thank you very much.
With much appreciation,
Deb

Start here:
NYS Real Property Actions and Proceedings Law (RPAPL) (http://www.tenant.net/Other_Laws/RPAPL/rpapl07.html)

The process is outlined starting with Section 731. You need to go your local Housing Court or the equivalent.
