I was arrested for theft of items that came to a total of $210. It was a misdomenor (sp) I went to my first court date and the judge entered a plea of not guilty for me, I go back to court next week. My question is, I am starting a new job and they will be running a background check, will this show up? I was told only convictions show up and I have not been convicted. I also have a lawyer and he said he could probably have the charges lowered (I don't remember to what) and I would most likely get 6 months to one year probation and if nothing happened in that time the charges would be romoved from my record.

Only convictions show on a background check, and Your attorney is most likely correct.

Thanks Scott, I also thought only convictions show up but I have been reading on other sites that arrests also show up. This doesn't seem very fair to me. I live in NY does anyone know for sure if only convictions show up?

Arrests will show on a police check. But not on a background check.

Thanks again! It is a ACD that my lawyer says I should receive. I had a friend who received one of those and made it through the probation period and was arrested again about a year later and it didn't even show when the police ran a check and they received another ACD. So the ACD sounds great to me plus I don't plan to ever make the same mistake again!
