Could I be sued by my employer for making a derogatory comment about her to a co-worker? Apparently some colleagues were in earshot and reported this to my boss. She had them write statements about what I said. I was called into a meeting where she tried to get me to admit to it and then asked me to sign a waiver of “non-retaliation” before she would allow me to read the statements. I told her that I didn’t want to read gossip and wouldn’t sign. This seemed to infuriate her. I asked her where this was leading and she refused to answer. My boss happens to be a former ADA. Can she sue me for slander? Fortunately, I'm a member of a union so she can't fire me --- only harass me on the job (which she is doing).

If what you said was untrue, yes she can sue you for slander. Will it be worth it to her, I don't know.

Have you discussed this with your Union Leader? It may be worth a go.

File a grievance with the Union through your shop Steward first. Maybe it will go away. Amazing how petty some people can be. People like that would not last long around my office.

Certain statements can be hurtful to the entire staff performance so be very careful what you say period.
