My husband just got arrested tonight for stealing and is charged with grand theft and dealing in stolen property. Is there a way he could get out of jail with a "release on one's own recognizace" where you sign a paper saying that you'll make it to court. Or will he definitely have to pay a bond/bail. What can I do to help him? We have absolutely no money right now.

It all depends on the severe issue. They should let him know when he gets booked in jail. More than likely you will probably have to do a cash assurity bond

Being granted bail has more to do with the defendants ties to the community than the severity of the crime. You can help him by hiring an attorney. I know you don't have money... Hire one anyway. Promise him your firstborn.

Has he been arraigned yet? Bail is set at the arraignment. The judge asks for recommendations from the prosecutor and the defense attorney, then decides what bail to set based on the type of crime, the defendants ties to the community, flight risk, etc.
