View Full Version : Served Judement papers in NY

Hi,

I have been served judgement papers for 2 different debts, one for an old credit card debt(has to be at least 6 ot 7 years) and one from a hospital bill from 2-3 years ago. I am going to pay these bills, but have been struggling financially. I can barely afford to keep my apartment and heat on for my kids. I recently found out I have a lung disease (COPD), since then my meds have become an expense. I have been paying old bills minimally based on what I can afford each week. I am so over my head with these old bills that I can barely sleep at night. Anyway, there is no date set on answering these judgements.It says that I need to go to the court, but below it says that I need not appear in person to answer and I don't know what to do. I was going to mail both companies and place a small payment, but I don't want to if I am still going to have a judgement declared against me. I cannot afford to have my wages garnished, as this will surely put me out in the streets. What can I do? Icannot afford a lawyer? One of the judgements is for $1900 and one is for $2800. Is there anything I can do or am I just out of luck?

Hello
First take a deep breath,calm down. In order to get a judgement you would have had to been served papers giving you a date to answer if you didn't answer the summons then they would have got a default judgement and then that's when they go after your wages accounts etc.
