I have been divorced from my ex husband for 9 years and he has been remarried for the last five years to a crazy drama queen. To make a long story short she has slapped my son across the face twice in the last year and a half and has been reported to DSS this last time by the counselor that I have been taking my son to see and because of this they have told him that on Thusrday of this week that they are going to see a attorney and that they are going to get custody of him and take him away from me. Our son is 10 years old and the love of my life what are the chances of this happening? We all live in the state of North Carolina

Let me get this straight. SHE slapped him and this abuse has been bought to the attention of DSS so now they think they can get custody?

I think the chances are slim and none. All you should need to do is get the counselor to testify before the judge and he should laugh in their faces.

Of course that's based just on what you've told us.

Number one... aside from any issues you have mention concerning the father and his new wife; it is EXTREMELY hard for a father to get full custody of the child if the mother is in disagreement. He would need to prove that it is in the best interest of the child.

Now, just that being said... coupled with the fact that there has been abuse issues, documented... the is no way they have any case to get full custody and "take him away". If anything, if you have joint custody right now, YOU would have more of a case to get full custody.
