I am currently renting an apartment with one roommate. Our lease was up 31 August 07. We have not received a renewal notice which, I am assuming our lease just automatically went to a month-to-month? We did however know our lease was up soon. Due to our differences as roomates, I have chosen to not renew with her. I have made other plans. Needless to say, she is not very happy. The leasing office is telling me that if I want to move, I have to have her release me. This is not making sense to me if our lease is up. They are also not requiring me to give 30 day notice even though it does state in our contract that a 30 day notice is required if on a month to month. I did one anyway. I just want to know why my roommate has to release me before I can move?? Thank you!!

I gather you are both signed on the lease? I would go back to the leasing office and tell them, that since we are now on a month to month lease that you are only required to give them 30 days notice that you are moving. That you are (or have) given that notice and will move out on x date. What your roommate wants to do is up to her.

Thank you so much! Yes, we are both on the lease but, the lease is up. I just want to make sure that I won't be finacially responsible after my 30 days is up? I don't know if apartment complexes do business all the same or how it works. I am in San Diego, CA. So, I'm sure states are different I just don't know about apartment complexes and the laws of California.

From what I know there is no such thing as this release.
