I've been in my apartment for almost four years and I have never renewed the lease agreement. Am I still under contract? Do I have to abide by the specific rules and regulations stated in the original agreement? I would also like to know if there is any law concerning a landlords ability to limit the number of times, per year, that you have overnight guest? This does not include how long they are allowed to stay.

Hello Holiday:

When your lease expired, it converted into a month to month tenancy. ALL the rules are the same except how long you're committed.

There is NO state law that governs your houseguests, but your lease might. Your landlord may visit anytime he wants with reasonable notice beforehand.

Yes the terms of the original lease still apply except for termination date and rental payment. So if the lease has some limit on overnight guests, then its still enforceable.

Remember, if you become an undesirable tenant for any reason, the landlord can terminate the tenancy just be giving you one rental period's notice.
