View Full Version : Tenant Stay Pass His Lease

My girlfriend has a condo which I am selling for her. The tenant was suppose to have moved out 4 days ago. He hasn't returned the keys to the property management company yet. We need to sell the property soon before the property goes into foreclosure. Is there anyway we can evict him ASAP? He won't let agent sshow the property, won't return phone call or emails. What can we do?

And that's the main problem with being a landlord nothing is done fast. Even if the tenant no longer holds a lease if they are living in the property or their stuff is still there you have to follow standard eviction procedures and the tenant doesn't have to do anything until the court tells them to leave. You can not harass the tenant into leaving or the judge will punish you for it even if any sane person would think you are in your rights. It sucks and you might be able to get some money back from the tenant afterwards but don't count on it.
