View Full Version : Caught for theft under 5000 twice

I am 23 years old... I already have a criminal record for theft and I had 40 hours of community service and 1 year probation... I just finished my 1 year probation about 6 months ago... and on August 9th I was shopping at zellers with my mom and my mom had some cosmetics in her hands that she asked me if I can hide for her.. I did so and then I bought the stuff I got for myself and took the makeup for her without paying for it.. we got caught and charged for theft under 5000... this is considered to be my second offence... the reason this happened is because we are tottaly broke because I just graduated from university and I don't have a job yet... can you tell me what will happen to me and my mom.. my mother never done anything like that before... the cops told me that I don't need a lawyer and that I can speak for myself... the cosmetics were worth $50...

The cops are not looking out for your interests so don't believe what they say.

If you had stolen some food I can understand, but there is no justification to stealing cosmetics. You obviously didn't learn from your prevous mistake.

I don't see jail time, but you will now have a criminal record and a much longer probation and CS sentence.

"note the first offece that happened was not really my fault because i was working as a cashier in this grocery store and a customer came to me and told me if i dont hook him up with some of the groceries he will do something to me..so i got scared and i did it..and after i cashed him out the security came and the guy ran away..and i was the one in trouble and then noone listened to me and i had to go to court for it because they thought that i purposely wanted to do it.."

So the first time wasn't your fault... And, this time it was your mothers fault... I got it. K, I don't care and the judge won't either. As a matter of fact, if you lay that bull crap on him, he'll give you twice as much time in jail.

Hello excon,

So you are basically saying that I will have a jail sentence.. if so how long do you think it will be.. and regarding that first offence I didn't steal food for myself.. I truly was threatened by this person and they still thought it was my fault because all the evidence were against me..

Yes I would say that it will be some jail time for a second offense.

Your mom will most likely get what you got the first time.

You need to not confess, not make any admitment. The police will lie to you, they are allowed to do that to get a confession and a conviction.

You need an attorney ASAP and actually sooner.
But you could have told your mom no, this is such an example of a bad parent, asking a child to steal.

And I hope you did not have a lot of get plans with your college degree, two arrests will most certainly hurt that.

I agree that you NEED and attorney. I don't agree that you will definitely get jail time. With the amounts we are talking about I don't think you will see jail time this time. But if you DON'T get an attorney to represent you the probabilty of jail time increases.

I would say that you need a lawyer. If they consider it theft that in itself is a felony. Not to mention that it is your second offense. The judge really isn't going to like that. If you go in there saying 'it isn't my fault' the judge REALLY isn't going to like you. My advice to you is to get a lawyer, admit that it is your fault, do your time, and grow up.
