View Full Version : Civil Action Summons Credit Debt ?

I received a Letter from my local court, being taken to court basically for money owed to Capital ONe Bank, c/o a attorney. In Philly, PA about 2 to 3 hours away. The amount is for a little over 3000 dollars. My credit report shows it as account closed at credit grantor's requests I have received plenty of letters from Collectors for this debt. And it seems like on my report that have charged some of it off. I plan on notifying the court that I attend to appear for the hear, just for the pure fact if the attorney. Does not drive from Philly for the 8:30 court that I can have it first all thrown out I'm sure. 2nd I've been looking on what I need to do to Validate this debt by SOL as well as the original contract or doc. I only have till 9/24/07 that's the court date any asst. would be helpful

First, charging off the debt does not affect your obligation to pay it. Its simply a tax move on the creditor's part.


Yes inform the court of your Intent to Defend and ask the plaintiff to provide documentation of the debt and their ability to collect it.
