My boyfriend and I moved into a rental house 5 months ago. He is not on the lease. The utilities and cable are in my name only, as well as the lease. I have asked him repeatedly to move out over the past few months and he refuses. He has no job or money and no one will help him as he has spent his life free loading. He claims he doesn't have to leave because "legally" my house is his place of residence and I can't just throw him out. He has never paid anything on any of the bills or food. He also claims his truck is broken and if I want him out sooner, I'll just have to pay to have it fixed or he can't drive anywhere. My lease expires the end of October and I will be moving. Is he correct that he doesn't have to leave, and if not, how do I get him to go? Also, if he ends up staying until my lease expires, how do I physically make him leave so I don't get in trouble? It's getting very difficult sharing the house with him now and I don't know what to do.

Legally the house is yours, not his, I would call the sheriff (or housing authority if there is one you can contact) and just ask what your rights are. Say your BF has moved in with you, is not on the lease or paying bills and refuses to leave.

My guess is you might have to give him a stated amount of time to get out in an official letter evicting him and if he won't leave he can be physically removed.

He is partially correct. He has established residency so you can't just throw him out. You have to go through a formal eviction process as he is YOUR tenant (not your landlord's). However, since you are moving in a little over two months, it will probably take you that long to get him out. So what I would do is just tell him, OK, you want to stay, I'm moving at the end of October. You will NOT be moving with me. If you are not out before then, the landlord will have you evicted.
