My husband and I have been given temp custody by cps of his son and his half sister the mother is a deadbeat she was charged with neglect and abandonment she has gone to a mental hospital twice in the past year, the last time for threatening to kill my husband and I, we have hired an attourney because we want full custody. The mom can't support these kids. She can't even pay 25.00 to see her kids at the gardner place, ( a home a parent goes to to have supervised visits with their kids. ) do you think my husband and I will have any problems getting these two wonderful kids ?

I don't think you will have a problem especially because they have been placed in your care, regardless if its labeled "temporary"... someone realized there was a problem where the children were at and did the smart thing and placed them with a safe family.
You have to prove that the mother is unfit to care for the children... which she seems to be proving all on her own. And since CPS has been involved and removed the children from the home, I don't see you and your husband having a problem. :)

Yes, of course you'll have problems. NOTHING in the court system goes as planned. There will be plenty of deference paid to the mother... I'm sure more than you'd like. However, that's as it should be. But, stick with it and you should prevail.

I don't think you will have a problem especially because they have been placed in your care, regardless if its labeled "temporary"...someone realized there was a problem where the children were at and did the smart thing and placed them with a safe family.
You have to prove that the mother is unfit to care for the children....which she seems to be proving all on her own. And since CPS has been involved and removed the children from the home, I don't see you and your husband having a problem. :)

I Just Think It's Sad That Someone Can't Afford 25.00 To See Their Kids, She Is Working At Mcdonalds And Lives With Pain Pill Addict And Alcoholic. The Mom Has Some Money And She Is Not Paying Child Support. So, I Don't Understand. But At The Least, We Should Get Joint Custody Right ?

The other thing is she has had 8 kids and until cps stepped in she only had custody of two of them, the two we have temp custody of now. Either the fathers have taken the kids or they were adopted. And she just had a premie in march and it was taken because it had opitates in its system, that is what prompted the state of tn to finally say enough, she had been called on like 5 times in a year!!

At the VERY least you would get joint custody... but I can't see you not getting full/sole custody. You have already been deemed fit, and able to properly care for these children, or CPS wouldn't have placed them with you.
You did the smart thing and got yourself an attorney, luckily that will take a lot of the headache out of it.
But again, I don't see you running into too many problems... I mean there are always a few setbacks that you have to expect going into the court system... but I don't see any judge returning those children to her especially since you have mentioned some of her past history with children.

Thanks so much, I hope so. We go back to court for a cps hearing on nov. 15th and we hope to have our case prepared with out attorney by then, it's just a prelminary hearing the court is having to review her case and track her progress, but we want to act as quick as we can on getting the custody set in stone, we can't imagine not having these kids in our life!
