After 12 years of my niece living with my parents, her maternal granparents, her mother now wants to make her live with her. My niece does not want to live with her but is afraid to say anything. My parents don't want to fight my sister on this but I do. My niece spends major holidays with my fiancé, our children and myself and also comes with us on all our family vacations. She only sees her mom about 3 times a year. I am the one she comes to for advice about growing up. Do I have any rights to fight for custody? He father has not seen her since she was 2 and has not made any effort to make contact with her since. I was told that my sister gets chid support for her but my partents never get any of that support. Please help any advice would be apriciated!

Sorry, not likely. This issue is between, if anyone, the grandparents and mom. You would have to check with a lawyer to be sure regarding the specific circumstances of your situation but it isn't likely the court would recognize you to have any rights to custody.

Is there any custody order in effect, does the grandparents currently have custody over the child, or did the mom just leave them there?

But it will end up in court if they wish to fight it
