I have a friend who believing that her brother would act in her best interest waived legal councel and appointed him Power Of Attorney over monies inherited through life insurance/ trust from her mothers death, now in hind sight she wishes to change her power of attorney and take control of it herself. Her brother refuses, and now she doesn't know what to do. Please help. My friend is also on ODSP, and suffers with a disease called PKU. She is concerned that ODSP will confiscate or cut her off, if she cashes in her inheritance. Her goal is to buy a small house. Therefore planning for her future. The brother says she cannot legally use her inheritance while on a perminant disability. He also TOOK half of her inheritance and invested in stocks. Without disscussing it with her. He also wants her to sign away her rights for one third of a property left to the three siblings.

Unless she made the POA non revolkable, she merely sends him a letter telling him that he is no longer the POA and he is not any longer.
She will send a copy of the letter taking away his POA to all the places where the money is at.

Also POA does not take away her right to go and get and do what she wants with the money, it only allows him to sign for her when she is not there, she can still go to anyplace where the money is at under her name and get it.
