My wages are being garnished. The company I work for adds in the money that they pay towards my health insurance on my paycheck then takes it right back out for the insurance. Can they take 25% of my wages including that money? It's not my takehome pay but it is for health insurance, so I'm not sure what the answer is. If anyone can help me I would greatly appreciate it. Thank you.

If its for your health insurance its not a garnishment of wage its your cost of the health insurance plan.
The way it works is lets say its cost the company $320 for single coverage (which is pretty average) well the company might pay 80% and then the employee is responsible for the remaining 20% since it is your insurance.
It works like taxes all that money is in your check and it comes out every pay day. Health insurance premiums work the same way.

No, it's not for health insurance. You are right that the company adds that money into my check then takes the total amount of health insurance out. But when you look at the total wages made it includes the amount that they pay for my health insurance. Can the garnishments be taken out of the total amount of wages including the money they add for my insurance?

Yes. That is your total amount of pay. From what I understand if there is a garnishment it is taken out of your regular pay before there are any deductions made. So its taken out of your total check, including any additional monies added it.

Since your company adds in your insurance premium it is probably technically considered "wages" and therefore subject to garnishment.
