I am an international student and am currently on CPT working on 1099 form. Is it legal to work on 1099. And I will be on OPT from October 1st. So is it legal to work on 1099 in my OPT period and on H1.

Which one will benefit me working on W-2 or on 1099?
Please tell me the answers.

I have the same question. I'm doing my CPT as an independent contractor working on a 1099 basis. I understand that your question has never been answered in this forum. However, did you get an answere from somewhere else?

There Are Certain Criteria That Has To Be Met To Be Legally Working On A Contract Labor Agreement, (1099 Form). You May Contact The I.r.s. And It Spells It Out Very Clearly What Is Legal.
For Example: Does The Owner Or Boss Tell You How To Fix Something, Or Just Tells You What Needs Fixing?
Do You Use Your Own Tools?
I Can't Remember The Rest , But Go And Check It Out With The I.r.s.
