I'm 22 yrs old and have a year and a half yr old daughter. Her father and I dated for sometime but are no longer together and don't speak either. His name isn't on the birth certificate and he has only seen her once when she was four months old. Does he have any rights?? Once paternity is established witll he have rights right away?? I live in Missouri and he lives in wi does that make a difference?? If anyone could please help me I would appreciate it very much!! :confused:

Sounds a bit like my situation. I don't believe he has any 'legal' rights if paternity hasn't been established. I am also dealing with the intra-state issue. Custody usually belongs to the mother, and the state that the child was born in.

Yeah but she was born in California and I moved to Missouri 6 weeks later.

Shouldn't matter. He isn't on the certificate, and paternity has not been established. Since women have great leverage in the courts, do nothing, and make him fight for his rights. It's the only option a man has with today's court. You have the power, neesanswers8306.

But once paternity has been established how does custody and visitation work?

He has no enforceable rights if paternity has not been established. Once paternity is established he can file a motion with the court for visitation. Once the court establishes a visitation order, you and he are bound by it.
