I may be a father to a child in Illinois. I live in Indiana. I cannot afford a private attorney, have been told that I cannot have the help of legal services in Illinois because I am not a citizen of Illinois, and Indiana can't help me because they do not have jurisdiction, and paternity has not been established.

I've spent over a year trying to work with the mother to do this right, but she refuses to work together on any level. I have finally come to the end of my rope, and have decided that whether this beautiful child is mine or not, I no longer have the desire to have anything to do with this whole situation.

The birth-mother has obliterated my vision of the miracle which is a child. This is a mother who once said she'd mail me an aborted fetus. A mother who made me believe my daughter was dead for two weeks. A mother who has two other daughters under her care right now. She has threatened me with a beating from her family members should I go anywhere near the child.

So, what I'm asking now, is if there is any way, since the mother will not cooperate, that I can legally be exempt from back-support in years down the road if the mother decides to come after me. I want to be protected from any attempt that she may make to do this. Is there anyway that in the eyes of the Illinois State law that I can be removed from any responsibility whatsoever when I have a completely uncooperative mother, and do not have sufficient funds to fight her in court?

If she can prove paternity, then the courts will make you pay.

If you are the biological parent and the DNA test can prove that, you are on the hook for the child support. If it is proven you are the Father, you have the option of fighting for custody.

Well first I will say it was you that decided to have sex with this wacko and now you have to live with the nut case.

To get to it, NO, if you are proved the father of the child, you will have to pay child support, all back child support and they will ( and god only knows how bad Illinois is on child support) they will come after you hard and bad. So just get used to a garnishment on your paycheck till it is all paid.

Next the first and main step will be a DNA test done thought the courts to first prove if you are the father.
Then you will have a hearing to determine custody, determine visitation, and to determine child support.

Next if she does not allow you to have vists, you take her back to court for contempt. If she threatens you, get a order of protection against her, and so on.
