View Full Version : Questions about eviction and a few other things

I am in the process of evicting a tenant she has not paid rent since June 1 and is not living in the home yet a few of her belongings remain. Due to many complaints from neighbors that someone other than the tenant is in the home (neighboor thinking homeless man living in home) I go to the home and leave a notice on door that I will enter within 24 hours and then I call tenant at her mothers home and let her know that she needs to secure the property someone may be going in. She does secure the home by locking down the window that was not locked. I arrive upon the 24 hour notice and enter the home to find a complete mess the window upstairs is nocked out and windows down stairs are now unlocked. I have the cops come to report the breaking and entering and damage to my property. I give tenant call during the time of my findings and I let her know that the neighbors complaints must be try and make her aware of the damages. She says she will have all belongings out within the next few days. Is she required to notify me when all her belongings are out of the house I really need to secure the home and have the electricity and water turned on (hoping this will make the homeless person residing on my property leave there is currently no water or electricity) What can I do about the situation? The home is in shambles thanks to the tenants ripping out carpet, comode the place is just trashed. We go to court on Tuesday for a status conference this is only to deciede where to hold the trial at circuit or magistrate. Should I notify tenant in a few days and see if she is out... I was thinking about placing another notice to enter on the door and entering at the end of the week to see if her belongings are out. When they are out can I began the locking down, cleaning process or should I just wait for court?

Good luck, I found once I tried to file an eviction, if they are not living in the house, here in TN you can't, since they have moved and deserted their property. So you have to give notice to dispose of their property,

I hope your court will hear the eviction after you get there.

I would contact them, and get them to give permission for you to take possession of the home to start cleaning,
