View Full Version : In CA who has custody of child born out of wedlock?

Hello everyone. I want to thank you in advance for any answers you may have.
My son is 8 years old. He was born out of wedlock. After 7 years of me raising my son by myself, I agreed to let my son live with his father for a year. This was a mutual and verbal agreement made by his father and I. Once the year was up, my son's father completely flipped on me. Said he wanted my son to stay with him. Of course I become infuriated and confused. My son is with me, for what his father thinks is only for the summer, but I don't want to send him back. I know reside in Georgia and their law indicates that "only the mother of a child born out of wedlock is entitled to his custody." That was excellen news to me. Unfortunately it didn't last long. My son was born in California. I'm having a difficult time finding out if I or my son's father has custody of my son. Please help. I don't think I'll see my son as often as I'd love to if I send him back to his father. I also don't want to break any laws by NOT sending him back to his father. Please keep in mind that we have NEVER gone to court for any legal custody of my son. Also, his father does live in Boston and my son did attend school there for one year. Any advise, information, or help is greatly appreciated.

Ok, that's out of the way. You need a lawyer. You needed one a long time ago, but that was then, and this is now. If you shop wisely, you'll find one you can work with.
