View Full Version : National Arbitration forum SOL Questions

I received a claim from National Arbitration forum on the behalf of Credigy Receivables inc. This debt was charged off on March 31 2002 by MBNA and sold to a few different companies till Credigy bought it. I live in Ma. And my SOL is 6 years. I want to know how I can prove when my last payment was because when I asked MBNA they told me they don't have that information or so they say. Ive gotten some information on how to stop the arbitration, with a letter of refusal to arbitrate. But when I refuse to arbitrate Im sure they are going to file a claim with my local district court. And at that time I will be forced to prove that I'm past the SOL and if I can't they will rule in Credigy's favor. Could anyone tell me if the SOL stops when they file a claim or the date the judge sees the suit.

You of course have the right to normally refuse Arbitaration, and demand a court hearing if you so beleivev your rights would be better protected.

National Arbitration forum is basically a business, where you agree to give up your rights to court, for a binding arbitration agreement.

Also these "judges" will be retired judges normally or legal experts, and are not sitting judges in US courts.
