It doesn't matter, you can't make him do anything. You would have to get a court order and I really don't think you would have a basis for that from you explanation of events. They weren't married, you were born out of wedlock. You are not a full blood so I don't know how you could be registered as one.

I wrote this question to find out if I can pursue a court order.
Um, actually the Cherokee Council has told me I am qualified. I just need to get the proof. You do NOT have to be full blood to be registered. MY family is on the Dawes Rolls. My purpose in doing this is to obtain a registrated card.

Being accepted as a legal tribe member, is a lot different than having a US birth certificate changed. Very seldom will the birth certificate be changed, a man can be declared the father by a court, but that is not the same thing as changing the physcial birth certificate.
But being declared the father is all that is needed to provide proof for tribal reason.
Based on what you asked tickle is correct, you are not asking or needing a change in a birth certificate ( which will not most liekly happen)
You are merely needed to provde proof of paternity
