I can't imagine it would be. Was he using the ladder properly? Did the landlord ask him to do it? It sounds like an accident, not the fault of the landlord, so I wouldn't imagine the insurance would pay up for it.

Probably not, unless the ladder was the landlord's property and is shown to be defective.
