I filed a small claims, have a court date for October. Today I received a letter, from a lawyer for the defendant, informing me of a NOTICE TO PRODUCE. I can't find any reference to this request anyplace in the NY state small courts information. If I don't produce all receipts, letters, any documentation I already have or receive before the court date, otherwise they will request the court to not allow any of the documentation I have to be considered. This is small claims not a trial! I thought I had to supply the judge and defendant with copies at the court date, not before. I'm going up against BIG MONEY and influence with this small claims, besides the defendant being a real nasty person, and I'm being nice here!:confused:

People have the right to discovery of evidence, that is what they are asking for. BUT>>>> at least in this area attorneys are not allowed at least in small claims court, but it appears they can be used prior to court.
If you don't have an attorney, expect them to trick you into losing somehow.
