My boyfriend violated his out of state probation in July of 2006. He was charged with simple assault. The judge gave him three months for the charge. He sat in PA prison system until Maryland picked him up in May of 2007. On June 28, 2007 the Baltimore City judge gave him his original sentence of 7 years. Is there anything we can do to get the sentence decreased? Also his time in PA which is almost a year does not count toward the 7 years he will have to serve. Is there anything we can do about this?

I have also heard of first time probation violators getting 6 months to a year for the violation and then placed back on probation.

Any help will greatly be appreciated!!

While this is about the max, it is legal for them to do this,

You can hire an attorney to try and appeal the verdict or the senctence, if there is a legal procefure violation. But no the time served in another jail on another charge does not have to be counted toward the original sentence.

I would assume his first charge was much more serious and the simple assault made the judge feel he was not living a crime free life.
