I have 4 questions, Before that I want to tell the background of the individual

Individual is resident in india and has gone to US for employment (total stay during April 06 to March 07 is less than 183 days) and has taxable income in India as well as in US



First Question

Whether the reallocation allowance which includes rent free accommodation is exempt from tax as per Indian Tax Laws? If not then Whether the reallocation tax payable to the US Tax Authorities, given by the employer to employee is also taxable?



Second Question

Whether the Surcharge @ 10 % when income exceeds Rs 10 Lacs, is to be calculated after giving benefit/credit of Tax paid in US under section 90 of Income Tax Act (Indian Tax Law)?


Third Question

Under DTAA with US what benefit a salaried person have regarding the taxation as compared to indian tax laws?


Fourth Question

What is the treatment of the accommodation provided by the employer in US on reallocation under the Indian Tax Laws?

It appears that all four questions involved the tax laws of India.
