View Full Version : Can I make partner sell the house

I have just split from my partner, we have a mortgage together- joint tenants in common. I am continuing to pay my half of mortgage and bills even though I have moved to my parents- with our baby. I have moved out as the atmosphere is terrible, and my ex refuses to leave. Can I make him hurry and start proceedings to buy me out or sell- he is in no rush as he is quite comfortable- in the house with bills paid- why would he do anything!
Do I have any rights to making him let me stay in the meantime- without him there, as I have the baby- doesn't feel right that I have had to move.
My partner still sees his son- but smokes weed and drinks alot- in the house, I'm very unhappy about this,
Please help, I just want an end to this relationship so I can move on.

I did not hear the magic legal term called married, if you were married, you file for a divorce and a property settlement, and the court can rule on the house.

If you are not married, and did not have a contract on what would happen if this , then you have a problem.

No you can not normally force them to move out ( but they can't force you to move out either) and you normally can't force them to sell if they don't want to sell either.

Time to see a local attorney and see if there is anything you may be able to do. Of course filing for custody of the child, formal child support and the such needs to be first.

Unless he agrees to either sell the house and split the proceeds, or refinance the home and buy out your interest, you need to hire an attorney who will file legal action. The judge will then compel him to do this.
