Hey Guys ,

Rigth now I am working on OPT and my employer has filed H1B for me . My application is accepted (since I got EAC number) but its not yet approved .

My question is , can change my employer once my application is approved or I have to wait till October when H1B will take into effect.

If not ,is there any other round about to work for different employer in my case ?

Please answer .

Thanks in advance .

NK

I'm not understanding, your currently on a CPT (student visa work experience) visa and the same employer will hire you on H1B in October?

You want to change to a new employer now or in October? Right now my guess is that you cant, CPT visa's are employer specific (so is H1B). If you want to change employers, waiti till the H1B is in effect and petition the new employer to have the visa transferred to them.

The H-1B Portability Rule: How to Change Employers (http://immigration.about.com/library/weekly/aa030902b.htm)

Right now you are still on CPT, so talk to the school if you want the work experience shifted to a new employer.

Actually it's basically the same thing, usually with OPT though you have finished your studies so I guess the school can't help though. You could apply for an extension on the OPT, as the employer if they would help. But in general OPT is 12 months maximum so they will most likely refuse unless your original visa was less than 12 months.
