View Full Version : Can my ex get child support from my current wife for my kid?

Thx to those that applied to my original question.

So assuming that they are able to get a child support order.. How do they figure the amount? My current wife and I have an LLC and we are both 50/50 partners. It's a Sub S corp, so we are on a salary.. we each get our own salary, the same amount each month. The rest of the money is left in the corp. Which is really not all my money. Is the amount of child support based on my salary alone or is my wife's salary taken in consideration or even worse can my ex go after the corp. I would have no problem paying for a child that is mine, not only would I be happy to pay for this child, but I would want to be a part of this his life. But I'm 99.9 % sure that this child is NOT mine. My ex has just became aware of the success of my wife and I and she is only coming around for the money. If this child were mine why would she not want to do a DNA test and get it over with.

You're getting ahead of yourself worrying about how much she can get. If you contest your paternity, the court will almost certainly require a paternity test before awarding her anything. Tell her that without a test, she's getting nothing. Better yet, get your lawyer to tell her.

Each state in the US has its own formula, some will look at the earnings of the custodial parent, and the entire family of the ones paying support.

Some base it only on the earnings of the non custodial parent.

And the earnings will be what ever the court says they are. If the parent with custody can convince the court you are hiding earnings in a S Corp, the court may demand records from the corp.

But you don't pay a penny until you get the DNA test that the court will require

In most states it's only your income they are concerned with... I'm a non custodial parent also and my ex is seeking to raise my support... I just hired an attorney who informed me as of may 6th the judge will now take into consideration how much my ex makes vs how much I make and decide what is a fair amount to support the kids... but no, they can't go after your wife's income
