I'll just get right to the point. My son's father wants to sign over his parental rights to my husband, we have a lawyer and it would cost us $1600 to do so. The only problem with doing that is we could take him to court and he could change his mind. Is there anyway I can get him to sign something before went went before the judge to possibly help me out. We live in Utah and he lives in California, what state do we file in? Thanks in advance for all the info.

What you would do is set up a legal contract and have the money held in escrow only to be paid at the final could order issues.

But you do know that if you don't, he will have to keep paying child support, so have you tried callinghis bluff and just say you are OK in just getting support from him ?

You file in the court that has the custody orders issues normally.

He owes $2300 in child support already and they say they will take his taxes, but his wife works at H&R Block so she knows the tricks af the trade in order to get around it. Well he hasn't called us since September the he called last month out of the blue and said that this is what he wanted to do. He hasn't even seen our son in over a year. Yeah I do live out of state, but he never shows for his visitation.

Wha state does he live in, can't you get a garnishment of his pay check?

Also why is he not in jail, some of my workers go to jail for oweing less than 1000 all the time.

California, he doesn't work. He'll work for about 6 months out of the year then he has had enough he sends his wife to work while he plays Mr. Mom.

Why do you think he would change his mind? He obviously doesn't want to be a father and definitely doesn't want to pay child support. So this is his way out. Sounds to me like he would be eager to do this.

I would make sure you get the back child support before anything is settled. I know someone who is owed 15,000 in back child support and they NEVER put the dad in jail... he gets to walk around free...

He has a habit of taking me to court just because. I live in Utah with the gas prices the way they are I don't want to drive back and forth to California all summer. Not to sure if he is eager to get this done if he was he would have called to check to see if I talked to the attorney.
