I am a software consultant. My Company "A" is applying for a L1 Visa so that I can work from US office branch of my company.

I have applied for a H1 B Visa in April 2007 from another company "B" and have received the Receipt number for the same.

My Questions are

1. If my company "A" applies for the L1 Visa, will my H1 B visa from company "B" will be cancelled by the US Immigration office.

2. If the answer to above question 1 is "No", then can I move from Company "A" to Company "B" once the H1 B Processing is complete and if yes, Do I need to shift immediately to Company B once I get the H1B Visa in Oct 2007 or can I continue working in Company A on L1 and later move to Company B some time in Mar 2008.

Hi Shifali,

If you are in the US working in L1 and have applied to a fresh H1, then you can join company B "anytime" after Oct 1st 2007. But, from your question, I understand that you are in India, and both the companies want to apply different Visa's for you. According to my understanding, there might not be any problem in getting the petition/approval but getting the stamping and travelling might become an issue and only one will be valid.

I think, you are looking to work in Company B for a longer term and Company-A might be your current employer. Its better you consult this scenario with your Company-B attorney, who can guide you in the right way.
