I work in NJ but live in NYC. I am confused over what forms I need to fill out. I believe I have made an error in that I have filed NJ state tax using the over the phone service. Now I am told that I should have filed as a nonresident in NJ which would have gotten me all of my NJ withheld tax back and then filled a NY state tax return. Can you give me instructions on what I should have done and what I should do now including what forms I have to use.

It is virtually impossible to walk you through that process using this forum. Time constraints keep me from trying to talk you through it over the phone.

Essentially, you will have to file an amended NJ tax return and attach a copy of the NJ schedule that details the taxes you have paid to NY/NYC to claim the credit.

Any tax professional in either NJ or NY can file that amendment for you. Go out and explain what happened and get a quote for what they would charge as a fee.

If you want it done before April 15th, I'll prepare the amendment for $100. If you are willing to wait until after April 30th, then my fee will go down to $50.
