OK... heres the thing. In late December and January, I stole some gift cards from a store I was working at at the time. The total came to 1000. One month later, I gave them the money back and appologized for stealing it. I was then told that they would be notifying the cops. 2.5 months later, I was arrested and charged with theft under 5000 and I'm to go to court on may 28.

This is my first offence and do not have a criminal record. I do have a lawyer, but I'm not meeting with him until next week and the questions that I have are driving me crazy.

Is it possible to settle this out of court so I do not end up with a criminal record... what are my chances of not having a criminal record after this is done... if I do community service, will I still have a record... I guess I want to know what my options are now.

Almost one and one-half years ago I was charged with theft under $5000 (< $40.00 ); following a session in diversion court no further action was applied---the original theft was returned---now,16 months later a law firm is demanding a rather large amount of money or is threatening legal action---this sounds like extortion---what is my legal position ?

Hello unc:

You shouldn't piggyback your question on somebody else's because it hurts their cause. You didn't know that, I'm sure and somebody will be along in a minute to move it.

It sounds like extortion to me too. See a lawyer.

There are lots of possibilities based upon lots of factors, many of which have yet to be played out. It's good that you have a lawyer. Kick back and relax until you see him.
