Hello, I live in Tennessee and my ex lives in Florida. When we settled our divorce, child support was enforced through the court system. When recorded on the papers for his income he only reported 200 dollars a week. I worked with him, and know that he made that only on check, and the rest ( which was about 500 at the time) was paid to him in cash, or under the table so to speak. I have reported this to child support, and they claim it will be a hard thing to prove. I told them he has been working there for the past 13 years , and no one who works 40 or more hours a week would make that kind of money a week. They asked if he was a waiter. He is not , he manages the kitchen and cooks for the restaurant. I am having child support "review" the case, but that just depends on his answers again on paper, no proof as to what he makes. How can this be proven so that he is paying the correct amount of support that he should be? How can these men get away with lying about what they make?:confused:

It will not be easy. Someone will need to analyze his spending habits. For example, If he earns $200/wk but lives an a rental costing $1000/mth, how is he managing that? Not sure who's responsibility it will be to do that.

In all cases involving divorce and custody of kids. Lying is rampant, no one even tries to investigate it. They just assume half of everything is lies. It sounds like from the response you got they think you might be lying. This whole system is in a mess. Even perjury under oath is rarely prosecuted.
So yes it my very well be imposable to prove.

Oh and I didn't mean that you were lying, just that it happens so much the people who work at this don't believe anyone.

The main trouble is the courts don't have the money or anyone to investigate, You need to see if you can get a PI to investigate his life style, maybe do some interview of people he works with and so on.

If I were in your shoes, I would contact the restaurant he works for and let them know you are calling the IRS, the Florida Labor Board, and the Attorney Generals Office to report their fraudulent labor law practices and for "cookin' the books". I wonder if they want to be audited by the IRS, investigated by Florida's Labor Board and Florida's Attorney General's office. Hmmm... wonder if they are up to health code... Do they employ illegal immigrants?

They know they are paying him under the table and if they are investigated in any way they'll most likely get caught or at the least, afraid of it. The threat of these governing organizations "harassing" them should put enough pressure on them to insist your ex do something to keep them off their backs!
Get on line and check on what governing offices you need to go through to get licensed by to open a restaurant. What are the labor laws? What are the consequences for breaking laws with a liquor license.

Don't the parents paying child support know if they lie and cut their kids out of money to get things they need... THEY ARE ONLY HURTING THEIR CHILDREN?! I get so mad about it!
