View Full Version : F-1 Student Filled 1040EZ instead of 1040NR

Hello,

I graduated at the end of 2013, then started my OPT on 2014. Took part on two internships that together lasted about 6 months after that I came back to my country. On March 5,2015 I e-filled through turbo tax a form 1040EZ which now I find out that should had filled a 1040NR. The 1040EZ was accepted and is still being processed.

I have read that I should amend the tax return that was filled but I am confused because TurboTax while it does not offer assistance for 1040NR form it helps you to amend the 1040EZ return. Is this the amended return I should mail with the properly done 1040NR? People say you should amend your return and attach an 1040NR. Maybe I am slow but I don't understand how should I do the amend.

Also how many times can you amend a tax return? What would I have to do in case I need it to amend more than once the same tax return? Are there consequences for amending more than once?

You can amend multiple times. In your case, prepare Form 1040X that shows the difference between the Form 1040EZ and the Form 1040NR-EZ.

If you are from India and did not claim any Earned Income Credit, there may be NO added tax due.

If you are from a country with no tax treaty with the U.S. you probably owe taxes because, unlike Indian students, you CANNOT claim the $6,200 standard deduction.

If you are from a country that has a tax treaty with the U.S. that has a substantial treaty exemption (like Germany with its $9,000 treaty exemption), you may actually get a refund with the amendment.
