View Full Version : Itemized deduction in state of Oregon for F1 student from India

Hi,


I am a single student from India on F1 status and was in state of Oregon for the entire 2014 tax year. As per Oregon state tax law, non-resident aliens cannot claim the standard deduction on the Oregon return.


Can I claim "State income tax claimed as an itemized deduction" on line 24 of form 40? From the instruction, it says to take the state tax amount mentioned on line 5 of federal schedule A form. But it doesn't say as non resident alien, whether I can claim it or not.

For federal form 1040-NR line 38, I only claim standard deduction of $6200 as itemized deduction.

I would say YES on claiming the state income taxes withheld as an itemized deduction on the Oregon return, but a phone call or email to the Oregon state tax authorities should get you a definite answer.
