If you have two 'owners' who paid for the home, are paying for the mortgage equally, but only one name is on the mortgage and they break up -- what happens? There is a paper trail with the mortgage payments, the mortgage origination payments, etc... and all the improvements on the house. This was done to avoid paying out money to a former wife in a divorce proceeding. Now, the boyfriend is splitting from the girlfriend and she wants it all. Her name is the only one on the deed and although there is a papertrail with his name, she says she can get it all even though she only makes $9 per hour as a bus driver and they live in a $600,000 house that he mostly (and can prove) paid for. Please help. (no I am not the new girlfriend, I am the sister in law). Thanks everyone. :confused:

At this point if her name is the only one on the deed, she owns the house all by herself,

He will have to sue in court and try to prove it was done to cheat his EX.
And of course that will give his ex some room to come in and sue him also.

This will be an interesting court battle.

But until the judge rules, she owns the house, since only one name is on everything.

All he can prove is that he contributed towards the house. But, by not putting his name on the deed, and the mortgage, he's left himself open to this.

Ever heard the expression "hoisted on his own petard"? That appears to be what's happened here. According to you he didn't pout his name on the assets to hide money from an ex-wife. If that comes out in court, his goose is cooked.

Next time, maybe he'll be more honest and less tricky. Unless he has contracts that show he has a half interest in the home I think she will get it all.
