The two roommates are getting into my personal belongings, documented mistreatment of my dog when I am at work. I work days they work evenings at a bar. The two come in at all hours of the night having loud parties and making noise. Discussions have led to serious arguments and I fear things will become physical. I spoke with my landlord, he approves that I can move out with 30 days notice. I have a 600.00 deposit I want to get back. I want the landlord to request the additional deposit from the two roommates that will stay, and he reimburse me for my portion. He wants me to work it out with the two roommates. They will hear none of it. What are my options and what should be done. The living conditions are so stressful I can't concentrate on work.

You might have to kiss the deposit goodbye. You are expecting your landlord to do what you should... get it from them yourself. You are the one technically breaching the lease, The landlord technically doesn't have to (and I'm not sure he would even be legally required to do it). He's doing you a huge favor even letting you alone out of it.

In fact in the past when I had roomates that's how we had to deal with it since the lease had specific ammounts of the deposite written into it... and a lease that's still in effect can't be modified without the agreement of all parties concerned.

You could try suing your roomates in small claims court to get it back.

Sometimes the best defence is no defences. Cut your losses and get out of there, if they are going as far as mistreating your dog.

I agree with the other responses. The only alternative I see is for you to find a replacement roommate and get the deposit from them. The landlord is doing you a favor so don't expect him to get involved in getting your deposit back. You might have to wait until the others move out also.

You could file suit against them in small claims court, but I'm not sure how that will go.
