My wife and I have a H-1B visa and our children have a TIN and have a H-4 visa. Can I claim them as dependents and do I qualify for CTC. Also my son attend an university, do I qualify for any tax benefits on the tuition I paid.

If the children were physically located in the United States for at least 183 days in 2013, then, for sure, you CAN claim them as dependents.

Now, whether you qualify for the Child Tax Credit depends on your income level. It has been my experience that H-1B visa holders tend to be rather well paid, and the CTC begins to phase out when the combined salaries hit $110K and goes away completely when they hit $130K.

Your income may also have a bearing on whether you qualify for any of the education credits for the college tuition.
