There is a tenant living in one of the dwellings. We want her to move the previous owner says she rents month to month. I have served her personally with an eviction notice her daughter threw back in my face. What can we do?

First you did not server her with an eviction notice, you served her a vacate notice. Only a court can issue an eviction notice.

Second, what did this notice say? The notice has give a proper time frame for them to vacate. That time frame is dependent on local laws and you neglected to give us a location.

Bottom line though, is it doesn't matter whether they refuse to vacate or not. Once the time frame in the vacate notice expires, you then go to court for an eviction order. If they still fail to vacate, you hire a sheriff to physically remove them.

You seem to be purchasing multiple dwellings? Do you plan on being a landlord or what?

(One of many reasons you NEVER buy property before you have proof that all tenants are gone, unless you want them there.)

Let me see you bought the building, so you never went and sat down and talked to the people, until they move, they are your renters, and owe them rent, when they move out, you will owe them a deposit back. So you needed to know all the details.

Also you did not go and just talk to them first, explain you are buying and will need them to move ?

And so they threw it in your face, they were given the notice, so when they do not move, you start eviction proceedings in the court.

*** if you are going to be a landlord, go to a real estate attorney, pay them by the hour, to explain all the rules of being a landlord in your state, have them prepare you proper forms to use for most issues.
