View Full Version : Indiana law about a child living in a home that a felon lives in

I am a felon in the state of Indiana. 6 months ago the Department of Children Services removed my grandchildren from their parents home due to the parents using drugs. Since this removal the parents lost their home because they were on government housing. They recently moved in with me. I have a "possession " felon from 2003, plea agreement. I currently work for an agency that contracts with this DCS, and I have a waiver from the state to work with children and their families. The DCS director in my county is refusing to allow the children to be placed back with their parents as long as they are living with me. What are the laws about children living with felon convictions.

I suspect that it is discretionary with DCS, depending upon the nature of the felony and other factors. In other words, DCS is probably given wide latitude in making this decision.

This is not something codified in law. But it is up to the discretion of DCS. So I doubt if there is anything you can do about it.
